Access to Justice: Theory and Practice (LAWS0321)

In the context of the recent Covid pandemic, the module will explore the principle of access to justice as central to the rule of law, and how unmet legal need can exacerbate health-harming inequalities. Students will engage with research on the challenges faced by underserved, disadvantaged and vulnerable groups in accessing and benefiting from legal services as a result of lack of knowledge about rights and entitlements, inability to pay for legal services, and decreasing supply of free sources of advice and representation.

It demonstrates the connections between legal, social and health problems; the obstacles to getting legal advice and potential remedies offered through grassroots and strategic levels via courts and tribunals. Students will explore leading empirical research in the field as well as practical examples of Covid related impacts and recent strategic litigation. While the course will have a strong focus on England and Wales, there will be some comparative components with other jurisdictions and draw on international sources such as the OECD and the United National Sustainable Development Goal Module reading lists and other module materials will be provided via online module pages, once students have made their module selections upon enrolment.

Access to Justice

This report examines how the measures introduced in response to coronavirus COVID have impacted vulnerable people that solicitors support. Policy decisions have needed to be made quickly to respond to a rapidly changing emergency situation and to protect public health and lives. While quick decision making has been necessary, it means that the measures implemented have not been scrutinised as much as they usually would. Disproportionate impacts on vulnerable groups have emerged and solicitors have played an important role in supporting people facing difficult circumstances. However, the measures used to tackle the pandemic have also changed how people access courts and lawyers.

Justice Canada is working to advance a people-centered approach to justice that puts consideration of the individual at the heart of justice responses by providing access to information, programs and policies. Legal issues are often embedded in a cluster of other problems that can affect many areas of life, including housing, employment, education and health. This makes it very important to address these problems as early as possible. Timely access to a fair and effective justice system, as well as access to information, resources and informal service, will help support the wellbeing of individuals and communities.

Rule of law , the mechanism, process, institution, practice, or norm that supports the equality of all citizens before the law , secures a nonarbitrary form of government , and more generally prevents the arbitrary use of power.
